000002619 520__ $$2eng$$aExperience of arbitrations and court litigations shows that the principal cause of disputes in construction projects mainly stems from bad contracts, bad construction management, and from contract parties' negligence. Several ways of solving disputes exist, starting from simple conciliation and ending with arbitration or court trials.In the framework of contract freedom, intermediate possibilities are available, one of them being the expert determination procedure. An expert agreed by the contract parties, or nominated by a third person on one party's request, adjudicates the issues in dispute.
